1. Who You're Dealing With

This portal is operated by the Company, a remediation and property cleanup services provider operating within McCracken County and surrounding jurisdictions in western Kentucky. The Company does not publicly disclose its ownership structure, parent entities, or affiliated subsidiaries through this portal. All contractual, legal, and service relationships are with the Company as referenced herein.

2. Scope of Services

The Company provides hoarding cleanup, biohazard remediation, trauma scene decontamination, and related property restoration services. Service availability is subject to crew scheduling, site assessment outcomes, and regulatory compliance requirements. Accepting a quote does not guarantee a specific start date. The Company reserves the right to decline, suspend, or terminate any job at its discretion — including situations where site conditions discovered upon arrival materially differ from what was disclosed during intake.

All services rendered through this portal are provided on a strict as-is, where-is basis. The Company does not warrant any outcome beyond the physical scope of work described in the signed service agreement. Clients accept full responsibility for the pre-existing condition of their property before work begins.

3. Liability — Read This Carefully

hoardingcleanuppaducah.com and any affiliated service providers assume zero liability for the following, without exception:

(a) Pre-Existing Structural Damage. Any structural damage, water intrusion, foundation compromise, subfloor deterioration, mold colonization, or load-bearing deficiency discovered during or after cleanup operations is entirely outside the Company's liability.

(b) Undisclosed Biohazards and Chemical Contamination. The Company operates based on conditions disclosed by the client prior to service commencement. Clients are legally and contractually obligated to disclose all known hazards in writing before any crew enters the property.

(c) Authorized Item Removal and Disposal. Any item explicitly authorized by the client for disposal, removal, destruction, donation, or transport is removed at the client's sole direction. The Company bears zero liability for the loss, destruction, or permanent removal of any such item once client authorization has been obtained and recorded.

The Company's total liability to any client, under any theory of recovery, shall not exceed the total amount actually paid for the specific service in dispute.

4. Regulatory Compliance

The Company conducts all biohazard remediation, waste transport, and disposal operations in formal adherence to the regulations administered by the Kentucky Energy and Environment Cabinet (EEC). Clients are advised that certain site conditions may trigger mandatory regulatory reporting obligations independent of the Company's service activities. Compliance with those obligations remains the property owner's responsibility.

5. Client Obligations Before Service Begins

Clients must provide accurate, complete disclosure of all known site hazards — including but not limited to animal waste, sharps, human remains, drug paraphernalia, chemical storage, and active pest infestation — prior to the scheduled service date. Failure to disclose known hazards voids any claim against the Company arising from those conditions.

6. Promotional Vouchers and Gift Cards

Any promotional voucher, discount certificate, or gift card issued in connection with hoardingcleanuppaducah.com carries a cash redemption value of $0.00. These instruments are entirely non-refundable, may not be exchanged for cash, and are completely void within the State of California.

7. No Email Contact Policy

This portal maintains a zero email footprint policy. No email address exists for legal inquiries, privacy requests, service disputes, or any other form of client communication. All legal notices and service inquiries must be directed exclusively by telephone to the dedicated dispatch line.

8. Indemnification

Clients agree to indemnify, defend, and hold harmless the Company, its crews, contractors, and agents from any third-party claim arising from the client's failure to disclose site hazards, misrepresentation of property ownership or authority, or violation of any applicable regulation related to the property's condition.

9. Governing Law and Jurisdiction

These terms are governed exclusively by the laws of the Commonwealth of Kentucky. Any dispute shall be adjudicated in a court of competent jurisdiction in McCracken County, Kentucky. Clients waive any right to bring claims in any other venue.

10. Modifications to These Terms

The Company may update these terms at any time. Revised terms take effect immediately upon posting to this portal. Clients are responsible for reviewing the current version before each service engagement.
